Assignment Title: Legal Framework Reform in the Field of Solid Waste Management

The Government of Azerbaijan has received additional financing from the World Bank toward the cost of the Integrated Solid Waste Management (ISWM) project, and intends to apply part of the proceeds for consulting services.
The consulting services (“the Services”) include assisting the Government of Azerbaijan in evaluating, proposing and drafting modifications to the existing legal and regulatory framework related to SWM in Azerbaijan and facilitate the implementation of the National Solid Waste Management Strategy. The updated legal framework, along with the National Strategy and the updated strategy for Greater Baku region, will establish the basis for future investments, objectives, activities and performance targets for service delivery and new facility development. Regional investment plans and programs (not subject to this consultancy) will be developed to translate national objectives into regional initiatives and targets. This combination of drivers and initiatives are expected to: Establish an improved institutional framework for improved solid waste management; Make local service providers more and clearly accountable for solid waste management services; Initially focus on collection and disposal practice improvements and, in particular the development of regional landfills serving groupings of Rayons and municipalities; Gradually introduce formal recovery and recycling programs; Lead to increased opportunity for allocation of sufficient budget and economic resources for skills development and capacity building; Provide an enhanced means for deriving the significant funds required to accomplish the target improvements across the country that will be defined in the National Strategy; Institute an effective and continual public communication and outreach campaign; Create favorable conditions for private sector participation in service provision and developing new facilities.
The Project Management Team (PMT) at the Ministry of Economy and Industry of the Republic of Azerbaijan now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria’s are: Experience in the legal aspects of solid waste management and environmental compliance legislation and regulations including experience in the content and development of laws and regulations in E.U. solid waste management and environmental laws and regulations; Experience in reviewing legal frameworks and drafting new legislation; Experience with SWM systems (planning, design and performance monitoring of specific elements of ISWM programs including collection, transfer, recovery and disposal).
The attention of interested Consultants is drawn to paragraph 1.9 of the World Bank’s Guidelines: Selection and Employment of by World Bank Borrowers (January 2011) (“Consultant Guidelines”), setting forth the World Bank’s policy on conflict of interest.
Consultants may associate with other firms in the form of a joint venture or a subconsultancy to enhance their qualifications.
A Consultant will be selected in accordance with the Quality-Based Selection (QBS) method set out in the Consultant Guidelines.
