The Upper Chamber of the European Human Rights Court (EHRC) considered the claim of the Azerbaijani IDPs from the Upper Karabakh and held hearings on the case of "Chiragovs and others against Armenia".
The plenipotentiary of Azerbaijan at EHRC Chingiz Askerov has informed that the government of Azerbaijan has taken part in judicial session on September 15 as the third party and has stated its position. During the Court's session, the Armenian side presented doubtful, false data. According to Ch. Askerov, the position of the Azerbaijani side has satisfied the Court. And as to the position of judges they are informed on the problem and understand that the question should be solved in a legal plane.
An important role in the action of proceeding has played the proofs which were presented by Azerbaijan. The major question was to prove that the Armenian state controls the occupied territories. This question has found reflection in the international legal documents. If ECHR will prove this, then, the fact of occupation by Armenia of the Azerbaijani lands and monitoring of these territories will become the first judicial decision. If the decision is positive, the Armenian state should pay to claimants an indemnification. Besides, the Ministerial Committee of the Council of Europe will control this decision, Askerov said.
The position of the Azerbaijan state consists in that first of all the refugees and IDPs have returned to their native land, and then other questions have to be solved. We have stated it at court session, Askerov said. The Armenian state wants the status of Upper Karabakh to be defined first and that the question of refugees and IDPs has to be solved after that.
Ch. Askerov, having informed that in ECHR has foiled 600 cases against Armenia and the number complaints grows every day. Only the judicial session on the case of "Chiragov and others against Armenia", has come to an end. Now the court should state its position. It is possible to consider that the court on this is coming to an end. Discussion of judges, probably, will occupy one-two month, then they will state their position.
